Arizona DUI Laws and Penalties


In the case of a first offense DUI in Arizona:

  • $250-$2500 fine plus $500 assessment fee
  • Suspended Driver’s license:  90 days
  • Jail time:  10 consecutive days (may be suspended 9 of 10 days by court if suspect agrees to an alcohol/drug evaluation/treatment)

In the case of a Second Offense DUI conviction in Arizona:

  • $500-$2500 fine plus additional assessment fees
  • Suspended Driver’s license:  license revoked for one year
  • Jail time:  90 days to 6 months (also the court may suspend 60 of the 90 days if suspect agrees to alcohol/drug evaluation/treatment
  • Ignition Interlock Device:  duration is at the discretion of the the court
  • Vehicle impoundment

In the case of a First Offense Extreme DUI conviction in Arizona:  (BAC .15% or above)

  • $250 fine plus additional assessment fees
  • Suspended Driver’s license:  90 day
  • Jail time:  30 consecutive days (also the court may suspend 20 of the 30 days if suspect agrees to get alcohol/drug evaluation/treatment
  • Ignition Interlock Device
  • Probation

In the case of a Second Offense Extreme DUI conviction in Arizona: (BAC .15% or higher)

  • $500 fine plus assessment fees
  • Suspended Driver’s license: 1 year
  • Jail time:  120 days (60 must be consecutive, and the court may also suspend 60 days if suspect agrees to alcohol/drug evaluation/treatment.
  • Ignition Interlock Device
  • Probation

In the case of a First Offense Super Extreme DUI (BAC.20% or greater)

  • $250 fine plus additional assessment fees
  • Suspended Driver’s license:  90 day
  • Jail time:  45 consecutive days (also the court may NOT suspend any of the sentence)
  • Ignition Interlock Device (mandatory)

Arizona Blood Alcohol Content (BAC) Levels of:

  • .001% – .05% – person presumed not to be under the influence/impaired
  • .051%-.099% – test results are admissible as evidence in court
  • .10% or higher – person presumed to be under the influence
  • .04% or higher – commercial drivers are presumed to be under the influence

Because Arizona has an Implied Consent law:

Blood, breath, urine, and chemical testing is allowed by the officer.  In addition, the police officer must warn the suspected impaired driver that their driver’s license will be suspended if they refuse the BAC test.  With BAC test results of .10% or higher, your license will be suspended for a minimum of 30 days.  Upon test refusal, your license is taken immediately.
