DUI Felonies

Extreme DUI conviction in Arizona (BAC – Blood Alcohol Content) is above 0.15 but below 0.20:

Minimim fine of $250
Minimum of thirty days in jail (consecutive)
Fine of $250 to the city or state treasurer
Fine of $1,000 for installation of inter-lock device in vehicle (1 year)
Felony charge on permanent record

When a BAC is above 0.20:

Minimum fine: $500
Minimum 45 days in jail (consecutive)
Fine of $250 to the city or state treasurer
$1,000 installation fee for Interlock Device in vehicle (1 year)

AGGRAVATED DUI FELONY CHARGE

A misdemeanor or Extreme DUI can become an aggravated DUI charge if a child under 15 years old is in the car at the time of arrest, if a driver’s license was revoked or suspended at the time of arrest, if the offender was arrested after being required to use an Ignition Interlocking Device, or if the offense is the 2nd DUI within 7 years.

Penalties for Aggravated DUI in Arizona may depend on the specifics of the situation:

Jail time- minimum 8 months in jail
Alcohol/Drug screening/education/treatment
License suspension – 1 year
Interlock Device installation (2 years)
Initial fine of $250
Minimum fine of $750
Fees paid to the county, state treasurer or city – $1,500
